1. Eligibility and Account Registration

JJsKitchen reserves the right to verify user age through documentation requests and will immediately terminate accounts of users found to be underage.

You must have the legal capacity to enter into binding contracts. If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1.3 Geographic Restrictions

The Service is primarily designed for users located in the United States and Latin American countries. We reserve the right to restrict access from specific jurisdictions where our Service may not comply with local laws or regulations.

1.4 Account Registration

2. User Account Responsibilities

2.1 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to:

• Choose a strong, unique password not used on other platforms
• Not share your password or account access with any third party
• Immediately notify JJsKitchen of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account
• Log out of your account at the end of each session on shared devices

2.2 Account Accuracy

You are responsible for ensuring that all information provided in your profile is truthful, accurate, and not misleading. This includes but is not limited to your age, location, marital status, physical appearance, occupation, and photographs. Misrepresentation constitutes grounds for immediate account termination.

2.3 Content Responsibility

You are solely responsible for all content you post, upload, or transmit through the Service, including messages, photos, videos, and profile information. You represent and warrant that you own or have necessary rights to any content you submit.

2.4 Monitoring and Reporting

You agree to monitor your account activity and promptly report any suspicious behavior, scams, or terms violations you encounter. JJsKitchen is not liable for your failure to report known violations or maintain account security.

3. Prohibited Activities and User Conduct

You agree not to engage in any of the following prohibited activities while using the Service:

3.1 Harassment and Abuse

• Harassing, threatening, stalking, or intimidating other users
• Sending unsolicited sexual content or explicit messages without consent
• Engaging in hate speech, discrimination, or abusive language based on race, ethnicity, religion, gender, sexual orientation, or disability
• Bullying, demeaning, or belittling other users

3.2 Fraudulent Activity

• Creating fake profiles or impersonating another person or entity
• Soliciting money, gifts, or financial information from other users
• Engaging in romance scams or advance-fee fraud schemes
• Providing false information about your identity, location, or relationship intentions
• Using the Service for commercial solicitation or business promotion without authorization

3.3 Illegal Activities

• Using the Service for any illegal purpose or in violation of local, state, national, or international law
• Promoting or facilitating prostitution, human trafficking, or illegal escort services
• Distributing or promoting illegal drugs or controlled substances
• Engaging in money laundering or other financial crimes
• Violating intellectual property rights or privacy rights of others

3.4 Technical Violations

• Attempting to gain unauthorized access to the Service, other user accounts, or our systems
• Reverse engineering, decompiling, or disassembling any part of the Service
• Using automated scripts, bots, or scrapers to access or collect data from the Service
• Interfering with or disrupting the Service or servers
• Circumventing security features or verification systems
• Transmitting viruses, malware, or other malicious code

3.5 Content Violations

• Posting pornographic, sexually explicit, or obscene content
• Uploading photos that contain minors or depict illegal activities
• Sharing content that infringes copyright, trademark, or other intellectual property rights
• Posting spam, chain letters, or unsolicited commercial messages
• Using photos of celebrities or public figures without authorization

4. Intellectual Property Rights

4.1 Platform Ownership

The Service, including all content, features, functionality, software, code, design elements, graphics, logos, trademarks, and service marks, is owned by JJsKitchen and protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

4.2 Limited License to Use

Subject to your compliance with these Terms, JJsKitchen grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include any right to:

• Reproduce, distribute, modify, or create derivative works of the Service

4.3 User Content License

By submitting, posting, or displaying content through the Service, you grant JJsKitchen a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and providing the Service. This license continues even after you stop using the Service for content that has been shared with other users.

You represent and warrant that: (a) you own or have the necessary rights to all content you submit; (b) your content does not violate any third-party rights including privacy, publicity, copyright, or trademark rights; and (c) you have obtained all necessary permissions from individuals appearing in photos or videos you upload.

4.5 Trademark Usage

The JJsKitchen name, logo, and all related product and service names, design marks, and slogans are trademarks of JJsKitchen. You may not use these marks without our prior written permission. All other trademarks, service marks, and logos used on the Service are the property of their respective owners.

4.6 DMCA Copyright Policy

JJsKitchen respects intellectual property rights and responds to clear notices of alleged copyright infringement. If you believe content on the Service infringes your copyright, please contact our designated copyright agent with a DMCA takedown notice containing the required information as specified by law.

5. Disclaimers and Warranties

5.1 Service Provided "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

5.2 No Guarantee of Results

JJsKitchen makes no warranty, representation, or guarantee that:

• You will find a romantic match, partner, or spouse through the Service
• Any relationships formed through the Service will be successful or long-lasting
• The Service will meet your specific requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• The quality of any matches, connections, or communications will meet your expectations

5.3 User Verification Limitations

While JJsKitchen implements verification procedures, we do not guarantee the accuracy, completeness, or authenticity of user profiles or representations. WE DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS. You are solely responsible for conducting your own due diligence and exercising caution when interacting with other users.

5.4 Third-Party Conduct

JJsKitchen is not responsible for the conduct of any user, whether online or offline. You agree to take reasonable precautions in all interactions with other users, particularly if you decide to meet in person. We strongly recommend following our safety guidelines and meeting in public places.

5.5 Relationship Outcomes

JJsKitchen disclaims all responsibility for any disputes, conflicts, injuries, property damage, emotional distress, financial loss, or other harm arising from relationships or interactions between users. Marriage and relationship success depends on factors outside our control.

5.6 International Relationships

Users pursuing cross-border relationships are solely responsible for understanding and complying with applicable immigration laws, visa requirements, and international regulations. JJsKitchen provides no guarantees regarding visa approvals, immigration processes, or successful relocation.

5.7 Technical Limitations

JJsKitchen does not warrant that the Service will be compatible with all devices, browsers, or platforms, or that translation features will be completely accurate. Technical issues, downtime, and service interruptions may occur without notice.

6. Limitation of Liability

6.1 Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JJSKITCHEN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SERVICE.

6.2 Direct Damages Limitation

Our total liability to you for all claims arising out of or relating to these Terms or the Service, whether in contract, tort, or otherwise, shall not exceed the greater of: (a) the amount you paid to JJsKitchen in the twelve (12) months preceding the claim; or (b) $100 USD.

6.3 Excluded Damages

JJsKitchen shall not be liable for damages arising from:

• Romantic relationships, marriages, or personal interactions between users
• User-generated content or conduct of other users
• Unauthorized access to or alteration of your data or communications
• Statements or conduct of any third party on the Service
• Immigration issues, visa denials, or international travel problems
• Financial losses from romance scams or fraudulent users (subject to our fraud prevention policies)
• Emotional distress, reputational harm, or personal injury from user interactions
• Service interruptions, technical failures, or data loss

6.4 Force Majeure

JJsKitchen shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

6.5 Basis of the Bargain

You acknowledge that JJsKitchen has offered the Service, set its prices, and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, and that these disclaimers and limitations reflect a reasonable and fair allocation of risk between you and JJsKitchen.

6.6 Jurisdictional Variations

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

7. Termination and Suspension

7.1 Termination by JJsKitchen

JJsKitchen reserves the right to suspend or terminate your account and access to the Service, with or without notice, for any reason including but not limited to:

• Violation of these Terms or any posted policies
• Engaging in prohibited conduct as outlined in Section 3
• Fraudulent activity or providing false information
• Non-payment of fees for premium services
• Inactivity for an extended period
• Requests by law enforcement or government agencies
• Technical or security reasons
• Discontinuation or modification of the Service

7.2 Termination by User

You may terminate your account at any time by accessing your account settings and following the account deletion process, or by contacting customer support. Upon termination, your right to use the Service will immediately cease.

7.3 Effect of Termination

Upon termination of your account:

1. Access Termination: Your access to the Service will be immediately disabled.
2. Content Removal: Your profile and personal information will be removed from public view, subject to our data retention policies and legal obligations.
3. Shared Content: Content you shared with other users (messages, photos sent to others) may remain accessible to those users even after termination.
4. Backup Retention: We may retain certain information in backup systems for a reasonable period as required by law or legitimate business purposes.
5. No Refunds: Termination does not entitle you to a refund of any prepaid fees unless otherwise required by law.
6. Survival of Terms: Sections of these Terms that by their nature should survive termination shall survive, including payment obligations, intellectual property provisions, disclaimers, and limitations of liability.

7.4 Suspension

JJsKitchen may temporarily suspend your account while investigating potential violations, security concerns, or payment disputes. During suspension, you will not be able to access certain features but your account information will be retained.

7.5 Account Reinstatement

If your account is terminated for violations, you may not create a new account without our express written permission. Attempts to circumvent termination by creating new accounts will result in immediate permanent ban.

8. Dispute Resolution and Governing Law

8.1 Governing Law

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

8.2 Informal Resolution

Before filing a claim, you agree to contact JJsKitchen at [email protected] to attempt to resolve the dispute informally. We will attempt in good faith to resolve disputes through negotiation within 60 days of receiving notice.

8.3 Binding Arbitration

If informal resolution is unsuccessful, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in English, and the arbitrator's decision will be final and binding.

8.4 Arbitration Procedures

• The arbitration shall be conducted by a single arbitrator
• The arbitration shall take place in Wilmington, Delaware, or via remote video conference
• Each party shall bear its own costs and attorneys' fees unless otherwise awarded by the arbitrator
• The arbitrator may not consolidate claims of multiple parties without consent of all parties
• Judgment on the arbitration award may be entered in any court having jurisdiction

8.5 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against JJsKitchen.

8.6 Exceptions to Arbitration

Either party may seek equitable relief in court for infringement or misappropriation of intellectual property rights, and either party may bring an action in small claims court if the claim qualifies.

8.7 Jurisdiction and Venue

To the extent arbitration does not apply, you agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in Wilmington, Delaware, and you consent to personal jurisdiction in these courts.

8.8 Statute of Limitations

You agree that any claim or cause of action arising out of these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

9. Modifications to Terms

9.1 Right to Modify

JJsKitchen reserves the right to modify, amend, or update these Terms at any time at our sole discretion. We may make changes to reflect changes in law, regulatory requirements, improvements to the Service, or for business operational reasons.

9.2 Notification of Changes

When we make material changes to these Terms, we will notify you by:

• Updating the "Last Updated" date at the top of these Terms
• Sending an email notification to your registered email address
• Displaying a prominent notice on the Service or through an in-app notification
• Requiring acceptance of new Terms before continued use of certain features

9.3 Effective Date of Changes

Changes to these Terms will become effective seven (7) days after notification, or immediately upon posting for non-material changes. Material changes affecting payment terms or dispute resolution will become effective 30 days after notification.

9.4 Continued Use as Acceptance

Your continued access to or use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Service and terminate your account before the effective date.
